Masten has filed for, and been granted, an application for a "certificate of appealability" with the 8th circuit court of appeals.

Former Kirksville Mayor Debbie Masten is back in the news.Masten has filed for, and been granted, an application for a "certificate of appealability" with the 8th circuit court of appeals.Masten claims in the appeal that her right of due process was violated when the prosecution failed to produce the original copy of the VHS surveillance tape, only providing

DVD copies, which Masten claims may not have been as accurate as the original VHS tape. Masten says in her appeal that the jury could have found her not guilty had they seen the original tape. Masten added that the original had never been provided to her.She was found guilty back in 2007 of setting the fire that damaged her business, Too Talls Two, in Kirksville. Masten's federal trial lasted two weeks, with the jury returning its guilty verdict in about two hours.Masten has since completed her sentence and has been released from custody.More Masten stories
