Gardner asks to withdraw as Techel's attorney
When Seth Techel enters a courtroom for his third trial on first-degree murder charges, he will likely do so with a new defense attorney.
Techel's current attorney, Steven Gardner, made a motion on Tuesday in Wapello County District Court asking to be allowed to withdraw from the case.
The motion cites that economic circumstances of the case and the health of Gardner are the primary reasons for the motion.
The motion also contains a statement from Seth Techel giving his consent for Gardner's withdrawal.
Gardner also filed a motion asking the court to appoint new counsel at state expense, citing a court ruling that Techel qualifies as indigent.
The motion states that Techel has requested Gerald "Jake" Feuerhelm of the Feuerhelm Law Office in Des Moines, Iowa, be appointed to the case.
Techel is expected to be in a Wapello County Courtroom on Nov. 25, as Judge Daniel Wilson will try to determine the best way to proceed toward a third trial.
